TERMS OF SERVICE

1. ACCEPTANCE OF TERMS

By accessing, browsing, or using the Try BotEngine platform and services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any part of these terms, you may not access or use our services.

These Terms of Service constitute a legally binding agreement between you (either as an individual or on behalf of an entity) and Try BotEngine regarding your access to and use of our trial services, including bot demonstrations, lead capture testing, and customer engagement automation solutions.

Your continued use of Try BotEngine services following any amendments to these Terms of Service will constitute your acceptance of such changes.

2. SERVICE DESCRIPTION

Try BotEngine provides trial access to AI-powered automation solutions designed for lead capture and customer engagement. Our services include:

Bot Demos and Trials: Access to demonstration versions of our AI bot technology, allowing potential clients to evaluate functionality, user interface, and integration capabilities within a trial period.

Lead Capture Testing: Trial implementations of automated lead capture systems that demonstrate how our technology identifies, collects, and organizes prospect information through conversational AI interfaces.

Customer Engagement Automation: Trial access to automated engagement tools that showcase how AI-driven conversations can interact with website visitors, answer queries, and guide users through defined workflows.

Trial services are provided for evaluation purposes only and are subject to time limitations, feature restrictions, and usage caps as specified during registration. Trial access does not guarantee availability of all features present in paid subscriptions. Try BotEngine reserves the right to modify, suspend, or discontinue any aspect of the trial services at any time without prior notice.

The trial period duration, specific features available, and any limitations will be communicated to you upon registration. Trial services are intended for business evaluation purposes and not for production use or commercial deployment.

3. USER OBLIGATIONS

As a user of Try BotEngine services, you agree to:

Provide accurate, current, and complete information during registration and maintain the accuracy of such information throughout your use of our services.

Use the services solely for lawful business evaluation purposes and in compliance with all applicable local, state, national, and international laws and regulations.

Maintain the confidentiality of your account credentials and accept responsibility for all activities that occur under your account.

Refrain from attempting to reverse engineer, decompile, disassemble, or otherwise derive source code from any aspect of our services or underlying technology.

Avoid using the trial services for any production environment, commercial deployment, or business-critical operations.

Refrain from excessive or abusive usage that may impact system performance or availability for other trial users.

Not resell, sublicense, distribute, or otherwise commercialize access to the trial services without express written permission from Try BotEngine.

Promptly notify Try BotEngine of any unauthorized access to your account or any other security breach.

Respect intellectual property rights and not upload, transmit, or process any content that infringes upon third-party rights.

Cooperate with reasonable requests for feedback, usage information, or evaluation data that may help improve our services.

Failure to comply with these obligations may result in immediate termination of your trial access without notice.

4. APPOINTMENT SCHEDULING AND CANCELLATIONS

Try BotEngine may offer scheduled demonstration sessions, consultation calls, or technical setup appointments as part of the trial experience.

Scheduling: Appointments may be scheduled through our online booking system, via email correspondence, or through direct communication with our team. You will receive confirmation of scheduled appointments via email at the address provided during registration.

Attendance: You are expected to attend scheduled appointments at the designated time. If you are unable to join a scheduled session within fifteen minutes of the start time, Try BotEngine reserves the right to consider the appointment forfeited.

Cancellations and Rescheduling: You may cancel or reschedule appointments by contacting Try BotEngine at least twenty-four hours prior to the scheduled time. Cancellation requests should be sent to Lucas.Parker@trybotengine.co with your appointment details.

Late Cancellations: Cancellations made with less than twenty-four hours notice may result in forfeiture of that appointment session, though Try BotEngine may exercise discretion in rescheduling based on circumstances.

Try BotEngine Cancellations: We reserve the right to cancel or reschedule appointments due to technical difficulties, staff availability, or other unforeseen circumstances. We will provide reasonable notice and work with you to reschedule at a mutually convenient time.

No-Show Policy: Repeated failures to attend scheduled appointments without proper cancellation may result in suspension of scheduling privileges or termination of trial access.

5. PAYMENT TERMS

Trial Access: The trial version of Try BotEngine services is provided free of charge for the designated trial period. No payment information is required to access basic trial features unless otherwise specified.

Conversion to Paid Services: Upon expiration of the trial period, continued access to Try BotEngine services requires conversion to a paid subscription plan. Pricing, billing terms, and payment methods for paid services will be provided separately and are subject to additional terms and conditions.

No Refunds for Trial Services: Since trial access is provided at no cost, no refunds are applicable. Any fees paid for upgraded trial features or early conversion to paid services are governed by the refund policy communicated at the time of payment.

Future Payment Obligations: If you provide payment information during the trial period for the purpose of automatic conversion to a paid plan, you authorize Try BotEngine to charge the applicable fees to your payment method upon trial expiration unless you cancel prior to that date.

Taxes: You are responsible for all applicable taxes associated with your use of paid services. Prices quoted do not include applicable sales, use, value-added, or other taxes unless explicitly stated.

6. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Try BotEngine, its affiliates, officers, directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses resulting from:

Your access to or use of or inability to access or use the trial services.

Any conduct or content of any third party using the services.

Any content obtained from the services.

Unauthorized access, use, or alteration of your transmissions or content.

Integration or compatibility issues with your existing systems or software.

Business decisions made based on trial service performance or capabilities.

Data loss or corruption occurring during the trial period.

In no event shall Try BotEngine's total liability to you for all claims arising from or related to the trial services exceed one hundred dollars, or the amount you paid to Try BotEngine in the preceding twelve months, whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you in their entirety.

Try BotEngine assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft, destruction, or unauthorized access to user communications or data.

7. WARRANTY DISCLAIMERS

Try BotEngine trial services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied.

Try BotEngine explicitly disclaims all warranties, including but not limited to:

Implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Warranties that the services will be uninterrupted, timely, secure, error-free, or free from viruses or other harmful components.

Warranties regarding the accuracy, reliability, or completeness of content, information, or results obtained through the services.

Warranties that defects will be corrected or that the services will meet your specific requirements.

Trial services are intended for evaluation purposes only. Performance, availability, and functionality during the trial period may not reflect the characteristics of paid production services.

Try BotEngine does not warrant that the trial services will be compatible with your existing systems, software, or infrastructure, or that integration will be successful or without complications.

You acknowledge that you use the trial services at your own risk and that you are solely responsible for any damage to your computer systems, loss of data, or other harm that results from such use.

No advice or information, whether oral or written, obtained by you from Try BotEngine or through the services shall create any warranty not expressly stated in these Terms of Service.

8. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms of Service shall be governed by and construed in accordance with the laws applicable to Try BotEngine's jurisdiction of operation, without regard to conflict of law provisions.

Any disputes arising out of or relating to these Terms of Service or the use of Try BotEngine services shall be resolved through good faith negotiations between the parties.

If negotiations do not resolve the dispute within thirty days, either party may pursue available legal remedies in the appropriate courts having jurisdiction over such matters.

You agree that any claim or dispute you may have against Try BotEngine must be brought within one year after the claim or cause of action arises, or such claim shall be permanently barred.

To the extent permitted by law, you waive any right to participate in class action lawsuits or class-wide arbitration against Try BotEngine.

9. INTELLECTUAL PROPERTY

All intellectual property rights in Try BotEngine services, including but not limited to software, algorithms, designs, text, graphics, logos, interfaces, and underlying technology, remain the exclusive property of Try BotEngine and its licensors.

Your trial access grants you a limited, non-exclusive, non-transferable, revocable license to use the services solely for evaluation purposes during the trial period.

You retain ownership of any data or content you input into the trial services. By using the services, you grant Try BotEngine a limited license to process, store, and display such content solely for the purpose of providing the trial services to you.

You may not copy, modify, distribute, sell, or lease any part of our services or underlying technology, nor may you create derivative works based on our services.

Any feedback, suggestions, or ideas you provide regarding Try BotEngine services may be used by Try BotEngine without obligation or compensation to you.

10. CONFIDENTIALITY

During your trial period, you may gain access to confidential information regarding Try BotEngine's technology, business methods, and proprietary processes.

You agree to maintain the confidentiality of such information and not disclose it to third parties without prior written consent from Try BotEngine.

You shall not use confidential information for any purpose other than evaluating Try BotEngine services for potential business use.

This confidentiality obligation survives termination of your trial access and continues for a period of three years thereafter.

11. DATA PRIVACY AND SECURITY

Try BotEngine collects, processes, and stores data in accordance with applicable data protection laws and our Privacy Policy, which is incorporated into these Terms of Service by reference.

During the trial period, Try BotEngine implements commercially reasonable security measures to protect your data, but cannot guarantee absolute security.

You are responsible for ensuring that any data you input into the trial services complies with applicable privacy laws and that you have obtained necessary consents for such data processing.

Upon termination of your trial access, Try BotEngine may delete data associated with your account in accordance with our data retention policies unless otherwise required by law or agreed upon in writing.

12. TERMINATION

Try BotEngine reserves the right to suspend or terminate your trial access at any time, with or without cause, and with or without notice.

You may terminate your trial access at any time by ceasing to use the services and notifying Try BotEngine of your decision.

Upon termination, your right to access and use the trial services immediately ceases, and you must discontinue all use of Try BotEngine technology and materials.

The following provisions survive termination: intellectual property rights, confidentiality obligations, warranty disclaimers, limitation of liability, and governing law provisions.

13. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Try BotEngine, its affiliates, officers, directors, employees, agents, and licensors from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorney fees) arising from:

Your use or misuse of the trial services.

Your violation of these Terms of Service.

Your violation of any third-party rights, including intellectual property, privacy, or other proprietary rights.

Any content or data you submit, upload, or transmit through the services.

Any business decisions or actions you take based on your trial experience.

14. THIRD-PARTY SERVICES AND INTEGRATIONS

Try BotEngine trial services may integrate with or provide access to third-party services, platforms, or content.

Try BotEngine is not responsible for and does not endorse any third-party services, and your use of such services is governed by their respective terms and conditions.

Any dealings with third parties accessed through Try BotEngine services are solely between you and such third parties.

15. EXPORT COMPLIANCE

You agree to comply with all applicable export and import control laws and regulations in your use of Try BotEngine services.

You represent that you are not located in a country subject to comprehensive sanctions and that you are not listed on any governmental restricted party list.
